National Family Planning & Reproductive Health Association and Family Health Council of Central Pennsylvania filed a lawsuit against the Trump administration on June 18, 2026, in the U.S. District Court for the Middle District of Pennsylvania. This litigation challenges the fiscal year 2027 Notice of Funding Opportunity for the federal Title X program.

The 2027 notice introduces a mandatory alignment review where political appointees screen grant applications to ensure they match agency priorities before any merit-based evaluation occurs. According to the lawsuit, this process allows the Department of Health and Human Services to distribute federal funding to entities based on political agenda rather than established statutory requirements.

Administration priorities for this alignment review include discontinuing support for diversity, equity, and inclusion initiatives and removing support for gender-affirming care. Lawsuits argue these requirements contradict the Title X statute, which mandates that the agency consider factors like local need, provider capacity, and patient volume.

Existing regulations require grantees to provide inclusive, nondiscriminatory care, including specific support for transgender patients. Experts assert that cutting grants to experienced providers could severely limit access to essential services like STI testing, contraception, and cancer screenings for low-income patients who rely on these clinics.

Long-standing providers who have participated in the program since 1970 now face the risk of total exclusion if their practices do not conform to these specific ideological priorities. Legal teams are preparing comprehensive arguments as the case moves forward under U.S. District Judge Yvette Kane.

Plaintiffs are seeking to have the new Title X rule declared unlawful under the Administrative Procedure Act and vacated immediately. Resolution of this high-stakes case may determine how political factors influence the future distribution of public health funds across the United States.

This dispute underscores a significant conflict between established federal program guidelines and the current administration's desire to reshape grant criteria. New screening measures are designed to enforce political and social alignment within the health department’s competitive award system.
