Amanda Zawieruszynski's bankruptcy filing will not stop a federal civil lawsuit accusing her of making false rape and kidnapping allegations against John Marks and former El Campo police detective Freddie Douglas after a judge ruled the litigation can move forward. The decision allows both men to continue pursuing defamation and civil rights claims after a grand jury declined to indict them on criminal charges stemming from the 2023 accusations.

Marks and Douglas contend they were wrongfully arrested after Zawieruszynski accused them of kidnapping and sexually assaulting her during an evening at Marks' Manvel home. As reported by ABC13, the men say officers arrested them without interviewing either of them or reviewing home surveillance footage they believe contradicted the accusations before a grand jury later refused to indict either man.

Security camera recordings from Marks' home have emerged as one of the dispute's central points. Motion sensors triggered recordings throughout the property, preserving portions of the evening.

Both plaintiffs are seeking damages from Zawieruszynski on claims including libel, slander, defamation and malicious prosecution. Marks and Douglas also named the City of Manvel, Police Chief Keith Traylor and Officer Taner Truitt as defendants, alleging wrongful arrest and violations of their constitutional rights.

Douglas alleges the arrest cost him his position with the El Campo Police Department, his Texas peace officer license and substantial income while damaging his reputation. Marks similarly argues the accusations caused lasting financial losses and emotional harm before the criminal case ended without indictments.

Zawieruszynski has denied the men's allegations and previously filed counterclaims. The consolidated federal action remains active following the bankruptcy ruling, with additional proceedings expected as the competing claims move toward resolution.

The ruling allows the civil action to continue while the court considers disputed testimony and claims against Zawieruszynski along with the Manvel officials named in the suit.
